When can I access my super? All conditions of release explained

Thursday 17 April 2025 at 11:00 am AEDT

There are strict rules on when and how we can access our superannuation, referred to as the conditions of release. This webinar will take you through each of these conditions of release and highlight how you can use them to your advantage!

IN CASE YOU MISSED IT: Watch our previous webinar, SuperGuide members Q&A: March 2025.

Q: My partner and myself have an SMSF set up with a company structure which is a trustee for our Super Fund. We both work with private organisations and our super falls into our SMSF. How can one transfer / rollover shares in a company name, from an SMSF, with 2 directors, to an industry or retail super fund when the time comes to close the SMSF?

If this is possible, are there any DIY super funds that would allow this?

A: Generally, when an SMSF is wound up to be transferred to a public fund the shares and other assets within it need to be sold.

The cash is then transferred to the new fund, to be invested as you choose there.

If assets are sold after the SMSF members have commenced pensions, the sale of assets that are in the pension phase does not attract tax.

As an alternative, some retail super wrap products are able to accept the in-specie transfer of listed securities, eliminating the need to sell. You can speak to your adviser and/or wrap providers directly to investigate their policies.

GST lodgement: Where your SMSF is registered for GST, your BAS is now due.
