Q: I have read several articles suggesting that putting money into the super account of my younger spouse could increase my Age Pension entitlement, since they are under 67 and their super is not assessed in means tests. Doesn’t this conflict with the gifting rules? Surely if I give my spouse several hundred thousand dollars, Centrelink will still assess it in my means tests for 5 years because it is a gift of more than $10,000. Please clarify.

A: Since couples are assessed on their combined income and assets, giving money or assets to your spouse is not captured by the gifting rules. The amount is still owned by one of the partners that is being assessed and has not been given away.

As a result, placing funds into the super account of the spouse that is under the Age Pension Age can increase the entitlements of the spouse who has reached the eligibility age.
