Q: I have a SMSF with my children and husband as members. My daughter has moved to the UK with the intention of becoming a citizen of the UK. Must she now withdraw her funds from the SMSF and place these into an industry fund?

A: According to residency rules the central management and control of an SMSF must be conducted in Australia. It is possible for trustee functions to be temporarily done outside Australia for up to two years, enabling fund members/trustees to temporarily relocate, but if a member/trustee intends to permanently relocate then they must be removed as a trustee and member for the SMSF to maintain its complying status. Any assets they hold in the SMSF must be transferred to an APRA regulated fund such as an industry or retail fund.

You should seek professional advice about your circumstances to ensure your fund complies with the residency requirements.

SMSF annual return (SAR): You need to lodge your SMSF annual return by this date if you are lodging it yourself. Also, if you are a newly registered SMSF and using a tax agent you need to lodge by this date, unless you were advised of a 31 October date at registration. This is also the payment due date for these funds.

GST lodgement: If your fund is registered for GST, which is becoming more common but not required for most SMSFs, and your GST turnover is more than $75,000, you will need to lodge your quarterly BAS by this day.

This would be most common for SMSFs that own commercial property and collect rent from that property. Rent received on residential property would not usually be subject to GST.

Where you employ a tax agent to help with these SMSF lodgements, check with them first as your SMSF may have adjusted lodgement deadlines.
