Q: My husband and I are selling our business after starting it 30 years ago from scratch.

I was of the understanding that we would be CGT exempt and that the proceeds of this sale could be deposited into our super without being counted towards our Non-concessional cap. The business sale proceeds is $275000 and we would be contributing half each to our super accounts.

Our super fund didn’t want to offer their opinion and the ATO adviser had no idea. We would submit the Capital gains tax cap election form to our super fund.

A: It sounds like you may be eligible for the small business 15-year CGT exemption on the sale of your business. This exemption can apply if you are 55 years or older, you’re retiring, and you’re disposing of a small business asset that you have owned for at least 15 years.

If you’re not eligible for the 15-year exemption, you may instead qualify for the small business retirement exemption which allows you to disregard up to $500,000 of capital gains from the sale of small business assets. If you’re under 55 at the time of using the retirement exemption, the amount you’ve excluded from CGT must be contributed to super. A super contribution is optional if you’re 55 or over.

Your accountant can help you to correctly apply the exemption you are eligible for, and you can make a contribution to your super fund using the CGT cap election form as you have mentioned.
